Why employers should conduct background checks.

There many reasons for performing background checks on potential employees but 3 reasons stand out: workplace safety, negligent hiring lawsuits, and Government sanctions.

Studies show that someone with a conviction of assault, battery, domestic violence or other crimes are more likely to be a repeat offender. Workplace violence is at an all time high as are lawsuits. Keeping workers and customers safe is a primary concern for businesses and organizations.  

Employers are being held responsible and liable for the actions of employees if they “should have known” their employee was a potential risk to the health, welfare, and safety of co-workers, clients, and the general public. Courts have upheld and 27 states have adopted Negligent Hiring Doctrines. On average, courts are awarding damages in negligent hiring cases of $1 million or more.

One of the largest negligent hiring verdicts was against a healthcare company for over $20 million. In that case, a home healthcare worker was hired without conducting a criminal background check. He stabbed and murdered a patient to cover up his theft. A criminal background check costing less than $35.00 would have shown prior felonies and falsified nursing credentials.  

Government sanctions and fines can and are levied against organizations that receive federal funding and fail to conduct proper background screenings on new employees. In one case, a healthcare facility that failed to conduct a Medicaid/Medicare fraud screening on two discovered that both had been convicted of fraud. The hospital was assessed a fine of $98,000.

Never checked before     -     County Criminal and a Social Security Search or a Credit Report on those handling valuables,  Motor Vehicle Report on drivers

Periodic checks     -     A regularly scheduled check of Driving Record or Credit will reveal changes in any behavior that might require some positive correction action. Periodic drug screening

Note

Ideally you should check any county the applicant has lived, worked or attended school.

Driver’s MVRs should be checked at a minimum annually, preferably twice a year to reveal potential problems or revoked / suspended license.

Employees with access to valuables/cash/stock/accounting information need a credit check quarterly to display changes in lifestyle, buying habits, debt, bankruptcy etc.

*Workers Comp reports can only be generated when a “Conditional” job offer has been made.

A signed release must be obtained prior to ordering any consumer report and client must be in compliance with the Fair Credit Reporting Act (FCRA), guidelines.
